AURIN TERMS OF USE

The Australian Urban Research Infrastructure Network (AURIN) provides researchers, policy makers and decision makers access to datasets and services through the “AURIN Portal”, “AURIN API” and “AURIN Map” and associated sites and functionalities administered by AURIN  or accessible through aurin.org.au (including all subdomains) (the AURIN Site). The AURIN Site includes the applications listed on the Workbench page, as updated from time to time.The University of Melbourne, as AURIN’s lead agent, administers, operates and controls AURIN. The AURIN Site is copyright © The University of Melbourne 2011 – 2019.

These terms govern your use of the AURIN Site. They describe the ways in which you can use the Datasets and e- tools made available through the AURIN Site, and define our rights to any contributions you may make to those Datasets and E-tools. We may make changes to these Terms of Use by publishing them on our website. These Terms of Use should be read together with AURIN’s Copyright and Attribution page and Privacy Policy.

AURIN WORKBENCH TERMS OF USE

AURIN provides a suite of data, analytical, and decision-support tools to policy-makers, researchers and industry. This allows evidence-based decision-making and leading edge research around Australia’s towns and cities to thrive.

Together, these tools are known as the AURIN Workbench.

Each Workbench tool have their specific set of terms for their use as listed below:

By using the AURIN Portal you acknowledge that you have read, understood and accept the following terms of use (“Terms of Use”):

AURIN Portal Terms of Use

1.  Interpretation

In these Terms of Use, a reference to “Data” means any information, data or other material accessible through the AURIN Site from time to time, and includes but is not limited to facts, geographic and location-based information, statistical or survey information, compilations and research results, whether in text or any other form. A reference to “AURIN E-tools” means any of the analytical tools available through the AURIN Site from time to time. A reference to a “Dataset” means a particular sub-collection of Data. All Datasets can be found here.

2.  Access

An account is required to access the AURIN Portal. Access to the AURIN Portal is restricted and can be accessed via the Australian Access Federation (AAF) secure portal login. Users associated with AAF collaborator institutions, approved researchers, policy-makers and decision-makers can use their AAF credentials to login and use the AURIN Portal. If your organisation does not have AAF credentials, you can apply for an account in the AAF Virtual Home Organisation. These accounts allow access to the AURIN Portal at   AURIN’s discretion.

You are responsible for keeping your login details confidential and secure. You may only access the AURIN Portal using your own personal login credentials. You must not share your account with anyone else. Please tell us if you suspect that the security of your account has been compromised, or if your account has been used by an unauthorised person or in an unauthorised way, by emailing support@aurin.org.au.

AURIN reserves the right to deny you access to the AURIN Portal if you do not comply with these Terms of Use, and withhold the right to introduce any further access restrictions in the future.

3.  Non-Commercial Use

AURIN E-tools may only be used as a resource for non-commercial purposes. Any commercial use of the AURIN Site, AURIN Data or AURIN E-tools is strictly prohibited.

Datasets must be used in accordance with its Relevant Data Licence which may prohibit commercial use.

4.  Dataset Licensing

AURIN supports open data and does its best to obtain Datasets under open data licencing frameworks. The AURIN Portal currently provides access to Datasets licensed under various licence types.

It is your responsibility to locate and abide by the correct licence for Datasets you access via the AURIN Portal (“Relevant Data Licence”). You must read the terms of the licence that applies to the Dataset you intend to use, and use that Dataset in compliance with the Relevant Data Licence. You can also find the metadata of Datasets by searching for the Dataset you have accessed via the AURIN Portal here, as well as from within the AURIN Portal application. The metadata associated with each Dataset will also state which licence applies and will provide a link to the Relevant Data Licence.

Your use of all Datasets is governed by both the Relevant Data Licence and these Terms of Use.  The Relevant Data Licence will prevail to the extent of any inconsistency between the terms of that licence and these Terms of Use.

Access to some Datasets may be subject to additional licence terms (“Data Terms & Conditions”). Such Data Terms & Conditions may include restrictions on use, specific attribution requirements and other important conditions. By clicking through any such additional terms related to the Dataset, you acknowledge that you have read, understood and agree to be bound by the Data Terms & Conditions, in addition to these Terms of Use and any applicable Relevant Data Licence.

5.  Attribution

You must properly attribute Data in accordance with the requirements of the Dataset’s Relevant Data Licence.

In addition to the requirements of the Relevant Data Licence you must also include the attribution of AURIN as the location that you accessed the Dataset in the following format or in a similar acceptable format:

[Data Source Organisation], ([Year]): [Dataset Title]; accessed from [[AURIN Portal]/AURIN Workbench/ [name AURIN sub-site]] on [date of access]

6.  Ownership of Intellectual Property

The AURIN Site is owned by the University of Melbourne. Data and AURIN E-tools are owned by the University of Melbourne, our project partners or other contributors to AURIN, listed here. For further information, please see our Copyright and Attribution page.

If you contribute to Data or AURIN E-tools you grant the University of Melbourne the right to use (including the right to sublicense), reproduce, publish, communicate or adapt your contribution in connection with the AURIN Site, and to provide access to your contributions to users of the AURIN Site subject to these Terms of Use (or any replacement to them). You confirm that any contributions you make to Data or AURIN E-tools are your own work, and do not infringe the intellectual property rights of any third party.

We assert our rights, or those of our project partners and contributors, in and to Data, but do not claim rights in your publications that incorporate Data.

7.  Data ‘as is’

Data comes from a number of third party data providers and those data providers are responsible for their particular Datasets. We do not warrant that Data is accurate, complete or up-to-date, or that its use will not infringe any third-party rights. Your use of Data is at your own risk. You should check the accuracy, completeness and currency of any Dataset with the relevant data provider before relying on it. Please notify us if you think any Data is inaccurate, incomplete, unreliable or out of date by emailing  support@aurin.org.au.

8. Indemnity

You indemnify the University of Melbourne against any claim, loss, damage, liability, cost or expense that we may incur arising out of your use of Data or AURIN E-tools, or your breach of these Terms of Use.

9.  External Websites

We sometimes provide links to external websites. We do not accept responsibility for, or endorse the content of, those sites.

10. Copyright Notices

If you believe that any Data or AURIN E-tools infringe your copyright, please notify us by completing our  Take Down Notice.

11.  Privacy

 

Data is generally provided in an aggregate or anonymised form. However, it may be possible to identify an individual from the Data (for example, by combining Datasets or analysing data with AURIN E-tools). You must not use the AURIN Site or Data in a manner that interferes with the privacy of an individual.

The ways in which we collect, use, hold and disclose personal information is set out in our Privacy Policy.

AURIN API

By using the AURIN API you acknowledge that you have read, understood and accept the following terms of use (“Terms of Use”)

The Australian Urban Research Infrastructure Network (“AURIN”) provides researchers, policy makers and decision makers access to Datasets and services. AURIN developed an open application programming interface (the “AURIN API”) to allow developers to develop user interfaces, such as mobile phone applications, web-applications and desktop GIS packages, to access Data through the AURIN API.

The University of Melbourne as AURIN’s lead agent, administers, operates and controls AURIN. The AURIN API and all AURIN API–related documentation, software and material provided or made available to you by AURIN, but excluding Data, (collectively, the ‘AURIN API Materials”) is copyright © The University of Melbourne 2011 – 2019.  For the avoidance of doubt, Data is owned by the data providers identified in the Dataset’s metadata.

These terms govern your use of the AURIN API Materials as a user of the AURIN API. They describe the ways in which you can use the AURIN API materials and the Datasets made available through the AURIN API. We may make changes to these Terms of Use by publishing them on our website from time to time. These Terms of Use should be read together with AURIN’s Copyright and Attribution page and AURIN’s Privacy Policy.

1.  Interpretation

2.  Access

AURIN reserves the right to deny you access to the AURIN API if you do not comply with these Terms of Use.  AURIN also reserves the right to introduce further access restrictions in the future.

3.  AURIN API Materials Licence

We grant you a non-exclusive, revocable licence to access the AURIN API and to use the AURIN API Materials on the terms set out in these Terms of Use.

You agree and acknowledge that AURIN or third parties may independently create applications or other products or services that may be similar to or competitive with the application or purpose for which you intend to use the Data. Nothing in these Terms of Use will be construed as restricting or preventing AURIN or any third party from creating and fully exploiting any applications or other products or services, without any obligation to you (including but not limited to any obligation to inform you of such development or exploitation)

4.  Dataset Licensing

AURIN supports open data and does its best to obtain Datasets under open data licencing frameworks. The AURIN API currently provides access to Datasets licensed under various licence types.

It is your responsibility to locate and abide by the correct licence for Datasets you access via the AURIN API (the “Relevant Data Licence”). You must read the terms of the licence that applies to the Dataset and use the Dataset in compliance with the Relevant Data Licence. You can find the metadata of Datasets by searching for the Dataset you have accessed via the AURIN API here. The metadata associated with each Dataset will state which licence applies and will provide a link to the Relevant Data Licence. Each Dataset will also have the licence short form title denoted in the abstract of the Dataset (for example a Creative Commons by Attribution 4.0 International licensed Dataset would be denoted in short form as CC-BY 4.0 etc.).

Your use of all Datasets is governed by both the Relevant Data Licence and these Terms of Use.  The Relevant Data Licence will prevail to the extent of any inconsistency between the terms of that licence and these Terms of Use.

5.  Attribution

You must properly attribute the Data in accordance with the requirements of the Relevant Data Licence. In addition to the requirements of the Relevant Data Licence you must also include the attribution of AURIN as the location that you accessed the Dataset in the following format or in a similar acceptable format:

[Data Source Organisation], ([Year]): [Dataset Title]; accessed from AURIN API [AURIN API hyperlink] on [date of access]

6.  Requirements for Your Users (your “End Users”)

You must ensure End Users of any product you develop utilising the AURIN API or Data comply with the terms of the Relevant Data Licence, these Terms of Use and any other terms of use or licence applicable to ensure your compliance with these Terms of Use.

For the avoidance of doubt, if you provide Data to your End Users you must provide the terms of the Relevant Data Licence to your End Users.

7.  Ownership of Intellectual Property

You acknowledge and agree that, other than the licence granted in paragraph 3 of these Terms of Use, all rights, title and interests (including any intellectual property rights) in and to the AURIN API Materials, including, in each case, any right, title, or interest (including any intellectual property rights) subsisting in any improvements to such materials, will at all times remain owned by the University of Melbourne or its licensors and nothing in these Terms of Use is intended to transfer any right, title, or interest (including intellectual property rights) to you.

For the avoidance of doubt, the Data is owned by the data provider.  Any modifications you make to the Data are governed by the terms of the Relevant Data Licence.

8.  Disclaimer

Data comes from a number of third-party data providers and those data providers are responsible for their particular Datasets. We do not warrant that Data is accurate, complete or up-to-date, or that its use will not infringe any third party rights. Your use of Data is at your own risk. You should check the accuracy, completeness and currency of any Dataset with the relevant data provider before relying on it. Please notify us if you think any Data is inaccurate, incomplete, unreliable or out of date by emailing support@aurin.org.au.

You agree and acknowledge that, to the extent permitted by law (including the Australian Consumer Law if applicable), we:

(a)           do not represent or warrant that the AURIN API Materials are free from errors or omissions, or that they are exhaustive;

(b)           do not represent, warrant or accept any liability in relation to the availability, reliability or quality of the AURIN API Materials; and

(c)           disclaim any warranties, representations or endorsements, express or implied, with regard to the AURIN API or the Data, including all implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

9.  Warranty

You represent and warrant that you have the right to use, reproduce, transmit, copy, publicly display, publicly perform, and distribute any product you develop utilising the Data (or in conjunction with the Data), and that a third party of that product will not violate the rights of any third party or any law.

10.  Indemnity

To the extent permitted by law, you indemnify AURIN, the University of Melbourne and its related bodies against any claim, loss, damage, liability, cost or expense that you may incur arising out of:

(a)           a breach of these terms;

(b)           your use of the AURIN API Materials; or

(c)            your use of the Data.

11.  External Websites

We sometimes provide links to external websites. We do not accept responsibility for, or endorse the content of, those sites.

12.  Copyright Notices

If you believe that any Data or the AURIN API infringes your copyright, please refer to our Take Down Notice or notify us by emailing support@aurin.org.au.

13.  Privacy

AURIN Map

By using the AURIN Map you acknowledge that you have read, understood and accept the following terms of use (“Terms of Use”).

The Australian Urban Research Infrastructure Network (“AURIN”) provides researchers, policy makers and decision makers access to Datasets and services. AURIN has implemented an instance of Terria Map, a geospatial data viewing application called the AURIN Map (the “AURIN Map”) which enables users to view pre-selected datasets within the application.

Please read these Terms of Use carefully before using the AURIN Map.
If you do not accept these Terms of Use, you may not use the AURIN Map.

  1. Compliance with Laws

As a condition of using the AURIN Map, you must comply with all applicable laws, regulations and third-party rights (including, without limitation, laws regarding the import or export of data or software, privacy and local laws). You must not use AURIN Map to encourage or promote illegal activity or violation of third-party rights.

  1. Data “as is” and Access

The AURIN Map website provides access to Datasets on urban infrastructure which have been provided by various third-party data custodians. AURIN makes no representations or warranties regarding the accuracy or completeness of any content or the product in connection with the AURIN Map.  Any information provided by data custodians displayed on the AURIN Map is provided as is and, on the understanding, that the respective data custodian is not responsible for, nor guarantees the timeliness, accuracy or completeness of that information. If you intend to rely on any information displayed on the AURIN Map, then you must apply in writing to the respective data custodian for further authorisation.

AURIN disclaims all responsibility and all liability (including without limitation, liability in negligence, for errors or omissions) for all expenses, loss, damage and costs which you might incur as a result of the information displayed on the AURIN Map and your use of it.

  1. General Use Only

The information displayed on the AURIN Map is for general informational purposes only, and is not intended to provide any commercial, financial, or legal advice. Any information in connection with the AURIN Map may not be appropriate to your individual needs. You must exercise your own independent, skill, care and judgment with respect to how you use the information displayed on the AURIN Map. In any important matter, you should seek professional advice relevant to your own circumstances.

The AURIN Map must not be used for navigation or precise spatial analysis or for any activities where the use or failure of the AURIN Map could lead to death, personal injury, or environmental damage (such as the operation of nuclear facilities, air traffic control, or life support systems).
